Terms & Conditions

Definitions

In these Terms and Conditions:

  • "Indo Yachts" refers to Indo Yachts and its affiliated entities operating yacht charter services in Indonesia.
  • "Charter" means the rental of a yacht, including crew and services, for a specified period.
  • "Guest" or "Charterer" refers to the person(s) booking and participating in the charter.
  • "Yacht Owner" refers to the owner or operator of the specific vessel chartered.
  • "Charter Agreement" refers to the specific contract between the Guest and Yacht Owner for each booking.

Booking & Confirmation

Inquiry Process

All charter inquiries are subject to yacht availability. Indo Yachts acts as an intermediary between Guests and Yacht Owners, facilitating the booking process and providing expert guidance.

Confirmation

A booking is confirmed only upon receipt of the required deposit and a signed Charter Agreement. Verbal or email confirmations are provisional until these conditions are met.

Guest Information

Guests must provide accurate information including full names of all passengers, passport details, dietary requirements, and any special needs or medical conditions relevant to the charter.

Payment Terms

Standard Payment Schedule:

50% deposit due upon booking confirmation

50% balance due 60 days prior to charter date

Accepted Payment Methods

Payment may be made via bank transfer or other methods as agreed. All payments must be received in the currency specified in the Charter Agreement.

Additional Expenses

The Advance Provisioning Allowance (APA), typically 25-35% of the charter fee, covers variable expenses including fuel, provisions, dockage fees, and special requests. Any unused APA will be refunded; additional expenses will be billed accordingly.

Cancellation Policy

Cancellation by Guest

  • More than 90 days before departure: Deposit forfeited, or may be applied to a future charter within 12 months (subject to availability)
  • 60-90 days before departure: 75% of total charter fee forfeited
  • Less than 60 days before departure: 100% of total charter fee forfeited

Cancellation by Yacht Owner

In the rare event a yacht becomes unavailable, Indo Yachts will work to secure a comparable replacement vessel. If no suitable alternative is available, a full refund will be issued.

Travel Insurance

We strongly recommend comprehensive travel insurance covering trip cancellation, medical emergencies, and evacuation. Indonesia's remote charter destinations may have limited medical facilities.

Charter Agreement

Each booking is governed by a Charter Agreement between the Guest and the Yacht Owner. This agreement details specific terms including itinerary, services, and any yacht-specific policies.

Indo Yachts facilitates this agreement but the contractual relationship for the charter services is between the Guest and the Yacht Owner.

Guest Responsibilities

Guests agree to:

  • Follow all safety instructions provided by the Captain and crew
  • Respect the yacht, equipment, and marine environment
  • Comply with Indonesian laws and maritime regulations
  • Ensure all guests behave appropriately and responsibly
  • Not engage in illegal activities including drug use or illegal fishing
  • Inform the crew of any relevant medical conditions

The Captain has final authority over all safety matters and itinerary decisions based on weather and sea conditions. The Captain may refuse service to any guest whose behavior endangers themselves, other guests, crew, or the vessel.

Liability & Insurance

Indo Yachts' Role

Indo Yachts acts as a charter broker and advisor. While we carefully vet all yachts and owners in our fleet, we are not liable for acts or omissions of yacht owners, crew, or third-party service providers.

Insurance

All yachts in our fleet carry appropriate marine insurance. However, this does not cover personal belongings, trip cancellation, or medical expenses. Guests are responsible for obtaining their own comprehensive travel insurance.

Limitation of Liability

To the maximum extent permitted by law, Indo Yachts' liability is limited to the commission received for the booking. We are not liable for indirect, consequential, or punitive damages.

Force Majeure

Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, or severe weather conditions.

In such events, Indo Yachts will work with all parties to find equitable solutions, which may include rescheduling or partial refunds.

Governing Law

These Terms and Conditions are governed by the laws of the Republic of Indonesia. Any disputes shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to arbitration in Singapore under SIAC rules.
